One of the key supposed 'platitudes' of contemporary epistemology is the claim that knowledge excludes luck. One can see the attraction of such a claim, in that knowledge is something that one can take credit for - it is an achievement of sorts - and yet luck undermines genuine achievement. The problem, however, is that luck seems to be an all-pervasive feature of our epistemic enterprises, which tempts us to think that either scepticism is true and that we don't know (...) very much, or else that luck is compatible with knowledge after all. In this book, Duncan Pritchard argues that we do not need to choose between these two austere alternatives, since a closer examination of what is involved in the notion of epistemic luck reveals varieties of luck that are compatible with knowledge possession and varieties that aren't. Moreover, Pritchard shows that a more nuanced understanding of the relationship between luck and knowledge can cast light on many of the most central topics in contemporary epistemology. These topics include: the externalism/internalism distinction; virtue epistemology; the problem of scepticism; metaepistemological scepticism; modal epistemology; and the problem of moral luck. What modal relation must a fact bear to a belief in order for this belief to constitute knowledge of that fact? Externalists have proposed various answers, including some that combine externalism with contextualism. We shall find that various forms of externalism share a modal conception of “sensitivity” open to serious objections. Fortunately, the undeniable intuitive attractiveness of this conception can be explained through an easily confused but far preferable notion of “safety.” The denouement of our reflections, finally, will be to (...) show how replacing sensitivity with safety makes it possible to defend plain Moorean common sense against the spurious advantages over it claimed by skeptical, tracking, relevant-alternative, and contextualist accounts. Sven Bernecker presents an analysis of the concept of propositional (or factual) memory, and examines a number of metaphysical and epistemological issues crucial to the understanding of memory. -/- Bernecker argues that memory, unlike knowledge, implies neither belief nor justification. There are instances where memory, though hitting the mark of truth, succeeds in an epistemically defective way. This book shows that, contrary to received wisdom in epistemology, memory not only preserves epistemic features generated by other epistemic sources but also functions (...) as a source of justification and knowledge. According to the causal theory of memory argued for in this book, the dependence of memory states on past representations supports counterfactuals of the form: if the subject hadn't represented a given proposition in the past he wouldn't represent it in the present. The book argues for a version of content externalism whereupon the individuation of memory contents depends on relations the subject bears to his past physical or social environment. Moreover, Bernecker shows that memory doesn't require identity, but only similarity, of past and present attitudes and contents. According to a tradition reaching back to Plato, questions about the nature of knowledge are to be answered by offering an analysis in terms of truth, belief, justification, and other factors presumed to be in some sense more basic than knowledge itself. In light of the apparent failure of this approach, knowledge first philosophy instead takes knowledge as the starting point in epistemology and related areas of the philosophies of language and mind. In order to lie, you have to say something that you believe to be false. But lying is not simply saying what you believe to be false. Philosophers have made several suggestions for what the additional condition might be. For example, it has been suggested that the liar has to intend to deceive (Augustine 395, Bok 1978, Mahon 2006), that she has to believe that she will deceive (Chisholm and Feehan 1977), or that she has to warrant the truth of (...) what she says (Carson 2006). In this paper, I argue that none of the existing definitions of lying identify a necessary condition on lying. I claim that lying is saying what you believe to be false when you believe that the following norm of conversation is in effect: "Do not say what you believe to be false" (Grice 1989, 27). And I argue that this definition handles all of the counter-examples to the existing definitions. (shrink)

Not every speech act can be a lie. A good definition of lying should be able to draw the right distinctions between speech acts that can be lies and speech acts that under no circumstances are lies. This paper shows that no extant account of lying is able to draw the required distinctions. It argues that a definition of lying based on the notion of ‘assertoric commitment’ can succeed where other accounts have failed. Assertoric commitment is analysed in terms of (...) two normative components: ‘accountability’ and ‘discursive responsibility’. The resulting definition of lying draws all the desired distinctions, providing an intensionally adequate analysis of the concept of lying. (shrink)

There is a fundamental disagreement about which norm regulates assertion. Proponents of factive accounts argue that only true propositions are assertable, whereas proponents of non-factive accounts insist that at least some false propositions are. Puzzlingly, both views are supported by equally plausible (but apparently incompatible) linguistic data. This paper delineates an alternative solution: to understand truth as the aim of assertion, and pair this view with a non-factive rule. The traditional view of lying holds that this phenomenon involves two central components: stating what one does not believe oneself and doing so with the intention to deceive. This view remained the generally accepted view of the nature of lying until very recently, with the intention-to-deceive requirement now coming under repeated attack. In this article, I argue that the tides have turned too quickly in the literature on lying. For while it is indeed true that there can be lies where (...) there is no intention on the part of the speaker to deceive the hearer, this does not warrant severing the connection between lying and deception altogether. Thus, I defend the following account of lying: A lies to B if and only if (1) A states that p to B, (2) A believes that p is false, and (3) A intends to be deceptive to B in stating that p. (shrink)

Lying is an important moral phenomenon that most people are affected by on a daily basis—be it in personal relationships, in political debates, or in the form of fake news. Nevertheless, surprisingly little is known about what actually constitutes a lie. According to the traditional definition of lying, a person lies if they explicitly express something they believe to be false. Consequently, it is often assumed that people cannot lie by more indirectly communicating believed‐false claims, for instance by merely conversationally (...) implicating them. In this paper, we subject this claim to an empirical test. In a preregistered study of 300 participants, we investigate how people judge cases of implicit deceptions that would usually be excluded by the traditional definition of lying (i.e., conversational implicatures, presuppositions, and nonverbal actions). Our results show that people do in fact consider it possible to lie by indirect means, suggesting that people have a broader concept of lying than is usually assumed. Moreover, our findings indicate that lie judgments are closely tied to the extent to which agents are perceived as having committed themselves to the believed‐false claims they have communicated. We discuss the implications of our results for the traditional definition of lying and propose a new commitment‐based definition of lying that can account for the findings of our experiment. This paper is divided into two parts. In the first part, I extend the traditional definition of lying to illocutionary acts executed by means of explicit performatives, focusing on promising. This is achieved in two steps. First, I discuss how the utterance of a sentence containing an explicit performative such as “I promise that Φ ” can count as an assertion of its content Φ . Second, I develop a general account of insincerity meant to explain under which conditions a (...) given illocutionary act can be insincere, and show how this applies to promises. I conclude that a promise to Φ is insincere (and consequently a lie) only if the speaker intends not to Φ , or believes that he will not Φ , or both. In the second part, I test the proposed definition of lying by promising against the intuitions of ordinary language speakers. The results show that, unlike alternative accounts, the proposed definition makes the correct predictions in the cases tested. Furthermore, these results challenge the following necessary conditions for telling a lie with content p: that you have to assert p directly; that you have to believe that p be false; that p must be false; that you must aim to deceive the addressee into believing that p. This article defends the view that liars need not intend to deceive. I present common objections to this view in detail and then propose a case of a liar who can lie but who cannot deceive in any relevant sense. I then modify this case to get a situation in which this person lies intending to tell his hearer the truth and he does this by way of getting the hearer to recognize his intention to tell the truth by lying. Communication is essential to human society, and assertion is central to communication. This article reviews evidence from life science, cognitive science, and philosophy relevant to understanding how our social practice of assertion is structured and sustained. The principal conclusion supported by this body of evidence is that knowledge is a central norm of assertion—that is, according to the rules of the practice, assertions should express knowledge.

The standard view in social science and philosophy is that lying does not require the liar’s assertion to be false, only that the liar believes it to be false. We conducted three experiments to test whether lying requires falsity. Overall, the results suggest that it does. We discuss some implications for social scientists working on social judgments, research on lie detection, and public moral discourse.

Assertions are our standard communicative tool for sharing and acquiring information. Recent empirical studies seemingly provide converging evidence that assertions are subject to a factive norm: you are entitled to assert a proposition p only if p is true. All these studies, however, assume that we can treat participants' judgments about what an agent 'should say' as evidence of their intuitions about assertability. This paper argues that this assumption is incorrect, so that the conclusions drawn in these studies are unwarranted. (...) It shows that most people do not interpret statements about what an agent 'should say' as statements about assertability, but rather as statements about what is in the agent's interest to do. It identifies some effective measures to force the intended reading of statements about what an agent 'should say', and shows that when these measures are implemented, people's judgments consistently and overwhelmingly align with non-factive accounts of assertion. In this paper I draw attention to a number of problems that afflict norm accounts of assertion, i.e. accounts that explain what assertion is, and typically how speakers understand what assertion is, by appeal to a norm of assertion. I argue that the disagreements in the literature over norm selection undermines such an account of understanding. I also argue that the treatment of intuitions as evidence in the literature undermines much of the connection to empirical evidence. In a recent article, Krauss (2017) raises some fundamental questions concerning (i) what the desiderata of a definition of lying are, and (ii) how definitions of lying can account for partial beliefs. This paper aims to provide an adequate answer to both questions. Regarding (i), it shows that there can be a tension between two desiderata for a definition of lying: 'descriptive accuracy' (meeting intuitions about our ordinary concept of lying), and 'moral import' (meeting intuitions about what is wrong with (...) lying), vindicating the primacy of the former desideratum. Regarding (ii), it shows that Krauss' proposed 'worse-off requirement' meets neither of these desiderata, whereas the 'comparative insincerity condition' (Marsili 2014) can meet both. The conclusion is that lies are assertions that the speaker takes to be more likely to be false than true, and their distinctive blameworthiness is a function of the extent to which they violate a sincerity norm. This paper defends the simple view that in asserting that p, one lies iff one knows that p is false. Along the way it draws some morals about deception, knowledge, Gettier cases, belief, assertion, and the relationship between first- and higher-order norms.

Almost all philosophers agree that a necessary condition on lying is that one says what one believes to be false. But, philosophers haven’t considered the possibility that the true requirement on lying concerns, rather, one’s degree-of-belief. Liars impose a risk on their audience. The greater the liar’s confidence that what she asserts is false, the greater the risk she’ll think she’s imposing on the dupe, and, therefore, the greater her blameworthiness. From this, I arrive at a dilemma: either the belief (...) requirement is wrong, or lying isn’t interesting. I suggest an alternative necessary condition for lying on a degree-of-belief framework. What is the relationship between lying, belief, and knowledge? Prominent accounts of lying define it in terms of belief, namely telling someone something one believes to be false, often with the intent to deceive. This paper develops a novel account of lying by deriving evaluative dimensions of responsibility from the knowledge norm of assertion. Lies are best understood as special cases of vicious assertion; lying is the anti-paradigm of proper assertion. This article accomplishes two closely connected things. First, it refutes an influential view about the relationship between perception and knowledge. In particular, it demonstrates that perceiving does not entail knowing. Second, it leverages that refutation to demonstrate that knowledge is not the most general factive propositional attitude.

In the philosophical debate on lying, there has generally been agreement that either the speaker believes that his statement is false, or he believes that his statement is true. This article challenges this assumption, and argues that lying is a scalar phenomenon that allows for a number of intermediate cases – the most obvious being cases of uncertainty. The first section shows that lying can involve beliefs about graded truth values (fuzzy lies) and graded beliefs (graded-belief lies). It puts forward (...) a new definition to deal with these scalar parameters, that requires that the speaker asserts what he believes more likely to be false than true. In the philosophical literature on the definition of lying, the analysis is generally restricted to cases of flat-out belief. This chapter considers the complex phenomenon of lies involving partial beliefs – beliefs ranging from mere uncertainty to absolute certainty. The first section analyses lies uttered while holding a graded belief in the falsity of the assertion, and presents a revised insincerity condition, requiring that the liar believes the assertion to be more likely to be false than true. The second section (...) analyses assertions that express graded beliefs, exploring how mitigation and reinforcement can alter the insincerity conditions for lying. Thomas Carson offers the most comprehensive and up-to-date investigation of moral and conceptual questions about lying and deception. Part I addresses conceptual questions and offers definitions of lying, deception, and related concepts such as withholding information, "keeping someone in the dark," and "half truths." Part II deals with questions in ethical theory. Carson argues that standard debates about lying and deception between act-utilitarians and their critics are inconclusive because they rest on appeals to disputed moral intuitions. He defends a version (...) of the golden rule and a theory of moral reasoning. His theory implies that there is a moral presumption against lying and deception that causes harm — a presumption at least as strong as that endorsed by act-utilitarianism. He uses this theory to justify his claims about the issues he addresses in Part III: deception and withholding information in sales, deception in advertising, bluffing in negotiations, the duties of professionals to inform clients, lying and deception by leaders as a pretext for fighting wars, and lying and deception about history, and cases of distorting the historical record by telling half-truths. Researchers have debated whether there is a relationship between a statement’s truth-value and whether it counts as a lie. One view is that a statement being objectively false is essential to whether it counts as a lie; the opposing view is that a statement’s objective truth-value is inessential to whether it counts as a lie. We report five behavioral experiments that use a novel range of behavioral measures to address this issue. In each case, we found evidence of a relationship. (...) A statement’s truth-value affects how quickly people judge whether it is a lie. When people consider the matter carefully and are told that they might need to justify their answer, they are more likely to categorize a statement as a lie when it is false than when it is true. When given options that inhibit perspective-taking, people tend to not categorize deceptively motivated statements as lies when they are true, even though they still categorize them as lies when they are false. Categorizing a speaker as “lying” leads people to strongly infer that the speaker’s statement is false. People are more likely to spontaneously categorize a statement as a lie when it is false than when it is true. We discuss four different interpretations of relevant findings to date. At present, the best supported interpretation might be that the ordinary lying concept is a prototype concept, with falsity being a centrally important element of the prototypical lie. (shrink)

Traditional definitions of lying require that a speaker believe that what she asserts is false. Sam Fox Krauss seeks to jettison the traditional belief requirement in favour of a necessary condition given in a credence-accuracy framework, on which the liar expects to impose the risk of increased inaccuracy on the hearer. He argues that this necessary condition importantly captures nearby cases as lies which the traditional view neglects. I argue, however, that Krauss's own account suffers from an identical drawback of (...) being unable to explain nearby cases; and even worse, that account fails to distinguish cases of telling lies from cases of telling the truth. I begin by criticizing reductionist knowledge-first epistemology according to which knowledge can be used to reductively analyze other epistemic phenomena. My central concern is that proponents of such an approach commit a similar mistake to the one that they charge their opponents with. This is the mistake of seeking to reductively analyze basic epistemic phenomena in terms of other allegedly more fundamental phenomena. I then turn to non-reductionist brands of knowledge-first epistemology. Specifically, I consider the knowledge norms of assertion and (...) contrast them with an alternative that I have developed elsewhere (Gerken 2011, 2012a, 2013b, 2014, 2015a, 2015c, MS). On the basis of the critical discussion, I question whether a knowledge-first program that is both plausible and distinctive has been identified. On a more positive note, I sketch the contours of an alternative that I label ‘equilibristic epistemology.’ According to this approach, there isn’t a single epistemic phenomenon or concept that is “first.” Rather, there are a number of basic epistemic phenomena that are not reductively analyzable although they may be co-elucidated in a non-reductive manner. This approach preserves some grains of truth in knowledge-first epistemology. For example, it preserves the idea that knowledge can be taken to be explanatorily basic and unanalyzable. However, since no single epistemic phenomenon is first, knowledge is not first. (shrink)
