Below are ongoing and upcoming public participation opportunities with the Air Pollution Control Division. These events may be in-person, virtual, or hybrid. The division holds regular events such as public meetings, tutorials, and more. The division uses these meetings to share updates, learn from community experiences, and incorporate feedback into our work protecting clean air for all Coloradans.

Upcoming public participation opportunities

Motor vehicle emissions testing 

The State of Colorado is planning to update Colorado’s vehicle emissions testing programs to help reduce air pollution. These proposed changes would enhance these programs, while also protecting convenience for vehicle owners subject to testing requirements. Please join a public meeting to learn about these proposed changes and next steps. You are invited to share your feedback and ask questions to help protect clean air in Colorado. Priority air toxics and health-based standards

Please join a public feedback session about the selection of priority air toxics and health-based standards and associated regulatory requirements. This work stems from a 2022 state law: Public Protections from Toxic Air Contaminants (House Bill 22-1244). All are welcome to participate and share feedback. Please focus your comments on the priority air toxics and health-based standards selection process. The live meeting will be recorded.

 

Ozone pollution reduction planning

Please join a public meeting to learn how Colorado plans to continue reducing ground-level ozone pollution across the Front Range. In July 2024, the U.S. Environmental Protection Agency approved the division’s voluntary request to reclassify parts of Colorado based on federal ozone pollution standards established in 2015. The reclassification provides the division with enhanced resources to continue identifying and implementing strategies to further reduce ground-level ozone along Colorado’s Front Range. The division will share proposed strategies for further reducing ozone pollution and updating Colorado’s State Implementation Plan. You are invited to share feedback and ask questions about these proposed strategies. The live meeting will be recorded.

Ongoing technical expert online meetings

The CDPHE Air Pollution Control Division will propose a rule to the Air Quality Control Commission in early 2025 to reduce methane pollution from municipal solid waste landfills. These landfills are significant sources of methane, which is a greenhouse gas that causes climate change. The division has convened a technical working group to support and inform the rule proposal.

The technical working group will meet regularly from August 2024 to November 2024. These meetings will focus on technical discussions among the working group members.

The technical meetings are open for public listening. The meetings are virtual and registration is required. Meetings will be recorded and published online for listening.

The Air Quality Control Commission’s procedural rules guide how the commission must run meetings and rulemaking hearings. The commission is considering changes to its procedural rules to update the rules and rulemaking process. These updates aim to modernize the process and better meet community needs.

The Air Pollution Control Division and commission are hosting online technical meetings in spring and summer 2024. Interested stakeholders are welcome to join. These meetings will go into detailed discussion about the procedural rules and proposed changes.

Between January 2024 and 2025, the division is hosting a scientific community technical working group. The working group is focused on toxic air contaminants. This group will help advance the 2022 state law: Public Protections from Toxic Air Contaminants Act (House Bill 22-1244). These technical meetings are open to the public. The meetings stream live online.

The Nitrogen Oxides (NOx) Reduction Steering Committee began meeting in March 2024. The members committed to holding meetings once a month for at least six months. During these meetings, members engage in technical discussions on potential strategies to reduce NOx pollution. The focus is on reducing NOx emissions from oil and gas exploration and production processes in Colorado. 

Meetings are held virtually. Members of the public are welcome to observe.

Colorado Air Quality Regulation Updates

The Air Pollution Control Division periodically proposes updates to existing air quality regulations to the Air Quality Control Commission. The commission reviews the proposals and determines whether to adopt any changes.

Many of these changes are minor or administrative. The division provides quick updates about these changes during public meetings.

Upcoming proposed changes to existing Colorado air quality regulations include:

  • Proposed updates include:
    • Updating and modernizing the rules dictating how the Air Quality Control Commission must run its meetings and rulemaking hearings. 
    • Simplifying the rulemaking process, making procedural rules easier to understand, and making the rulemaking process more accessible to community members. 
  • Hearing date: November 20-22, 2024

  • Proposed updates include:
    • Inflation adjustments for maximum fines and penalties for air quality control violations. 
    • These revisions to the Common Provisions regulation are required by the Environmental Justice And Projects Increase Environmental Fines Act, House Bill 20-1143.
  • Hearing date: October 16-18, 2024

  • Proposed updates include:
    • Considering revisions to Regulation Number 7 to include the midstream segment emission reduction plan. This may also include revisions to Regulation Number 26 and Number 27.
    • The division will also request that the Commission set a hearing to consider revisions to Regulation Number 25 and Number 26 to address recent U.S. Environmental Protection Agency actions on state implementation plan provisions.
  • Hearing date: December 16-18, 2024

  • For Part A, Greenhouse Gas Reporting, proposed updates include: 
    • Addressing changes the U.S. Environmental Protection Agency made to the federal Greenhouse Gas reporting rule.
    • Expanding greenhouse gas reporting requirements to municipal solid waste landfills that do not currently report greenhouse gases.
  • Hearing date: October 16-18, 2024
